These Terms & Conditions ("Terms") govern your access to and use of the Harper Grove Sourdough Co. website, online ordering system, products, and related services. In these Terms, "Harper Grove," "we," "us," and "our" refer to Harper Grove Sourdough Co.
By using this website, submitting an order, or otherwise purchasing products from us, you agree to these Terms and acknowledge our Privacy Policy.
If you do not agree to these Terms, do not submit an order or use the website to purchase products.
1. Eligibility and Personal Use
You must have legal capacity to enter into a binding agreement to place an order through this website. If you place an order on behalf of another person or organization, you represent that you have authority to do so.
Unless we expressly agree otherwise, products are sold directly to customers for personal consumption and not for unauthorized resale or commercial redistribution.
2. Products and Availability
Harper Grove produces fresh, small-batch baked goods. Products, flavors, quantities, bake dates, pickup times, delivery availability, and other offerings may vary from bake to bake and are subject to availability.
Displaying a product on the website does not guarantee that the product will remain available. Quantities may be limited, and a product may sell out before ordering closes.
We may modify, discontinue, limit, or refuse the sale of a product when reasonably necessary, including because of ingredient availability, production limitations, quality concerns, safety concerns, pricing errors, technical problems, or circumstances outside our reasonable control.
3. Product Information
We make reasonable efforts to accurately describe our products, ingredients, prices, photographs, availability, and other information.
Because our products are handmade, natural variations in appearance, shape, color, scoring, texture, size, weight, rise, crust, crumb, and other characteristics may occur. Such ordinary variations do not by themselves mean a product is defective.
Photographs are illustrative and may not exactly represent the specific handmade item you receive.
4. Ingredients, Allergens, and Dietary Needs
Our products may contain or come into contact with food allergens. Depending on the products being prepared, our baking environment may handle ingredients containing wheat, milk, eggs, soy, sesame, peanuts, tree nuts, and other allergens.
We do not represent that our kitchen, equipment, storage areas, preparation surfaces, ingredients, or products are allergen-free unless we expressly state otherwise in writing for a particular product.
Customers with food allergies, sensitivities, celiac disease, or other medical or dietary restrictions are responsible for reviewing applicable ingredient and allergen information and determining whether a product is appropriate for them.
If you have a severe allergy or questions about ingredients, contact us before ordering. Do not consume a product if you believe doing so may be unsafe for you.
Nothing in this section reduces our obligation to provide truthful product information or comply with applicable food safety and labeling requirements.
5. Prices, Fees, and Taxes
Prices are shown in U.S. dollars unless otherwise stated. Applicable delivery charges, taxes, or other disclosed charges may be added to an order when required.
We may change prices prospectively at any time. A price change will not ordinarily affect an order that we have already accepted, except where correction is reasonably necessary because of an obvious pricing, calculation, or technical error.
Before submitting an order, you are responsible for reviewing the products, quantities, fulfillment method, price, fees, and total displayed at checkout.
6. Orders and Acceptance
Submitting an order is an offer to purchase the selected products under these Terms. Receipt of an automated order submission or website response does not prevent us from correcting an error or declining an order when reasonably necessary.
We may reject, limit, or cancel an order for legitimate reasons including insufficient inventory, incorrect pricing, suspected fraud or abuse, inability to fulfill the requested order, safety concerns, technical errors, or circumstances beyond our reasonable control.
If we cancel an order after receiving payment, we will provide an appropriate refund of the amount paid for the cancelled portion of the order.
7. Payment
Available payment methods are displayed during checkout. Depending on the options then available, customers may be able to pay electronically or pay when receiving an order.
If electronic payment is offered, payment processing may be provided by an independent third-party payment processor. Your use of that processor may also be subject to the processor's terms and privacy practices.
You represent that you are authorized to use the payment method submitted for an order.
8. Pickup
Customers selecting pickup are responsible for selecting an available pickup window and collecting the order at the location and time communicated in the order confirmation or subsequent fulfillment instructions.
Pickup instructions, including any private residential pickup location, are provided for the purpose of completing the customer's order. Customers must respect the property, privacy, instructions, and reasonable boundaries associated with the pickup location.
If you expect to miss your selected pickup window, contact us as soon as reasonably possible. We cannot guarantee that an alternate pickup time will be available.
9. Local Delivery
Delivery is available only when offered by Harper Grove and only within the delivery area identified during checkout.
Customers are responsible for providing a complete and accurate delivery address and any information reasonably necessary to complete delivery.
We are not responsible for delays or failed delivery caused by an inaccurate or incomplete address, inaccessible property, unsafe conditions, inability to contact the customer, or other circumstances outside our reasonable control.
Delivery times are estimates or designated windows unless expressly stated otherwise. Weather, traffic, emergencies, road conditions, production issues, and other circumstances may cause delay.
10. Cancellations, Changes, and Refunds
Our products are fresh, perishable goods and may be made or allocated specifically for individual orders. For that reason, the ability to cancel or modify an order may become limited once ingredients, inventory, or production have been committed to that order.
If you need to cancel or change an order, contact us as soon as possible. We will determine whether the requested change can reasonably be accommodated based on the status of the order.
Refunds or replacements may be provided when appropriate, including when we are unable to fulfill a paid order or when required by applicable law.
Nothing in these Terms eliminates any refund, replacement, or other remedy that cannot lawfully be excluded.
11. Problems With an Order
If there is a problem with an order, please contact us promptly and provide enough information for us to evaluate the issue.
Depending on the circumstances, an appropriate resolution may include correction, replacement, refund, partial refund, store credit, or another reasonable remedy.
We may request photographs or other reasonable information when necessary to understand a claimed product or fulfillment problem.
12. Food Storage and Handling After Delivery or Pickup
Once an order has been delivered or picked up, the customer is responsible for appropriately storing, handling, and consuming the products.
Follow any product-specific storage or handling information provided by Harper Grove. Quality and safety may be affected by improper storage, excessive heat, moisture, contamination, prolonged storage, or other conditions after the product leaves our control.
13. Website Availability
We work to keep the website available and accurate, but we do not guarantee uninterrupted or error-free operation.
The website may occasionally be unavailable because of maintenance, updates, internet or hosting outages, hardware or software failures, cybersecurity events, or other circumstances.
14. Acceptable Use
You may not misuse the website or ordering system. Prohibited conduct includes:
- Submitting fraudulent or unauthorized orders.
- Attempting to gain unauthorized access to accounts, systems, databases, servers, or administrative functions.
- Interfering with or disrupting the website or its supporting infrastructure.
- Introducing malicious code or attempting to exploit a vulnerability.
- Using automated methods to scrape, overload, abuse, or circumvent normal website functionality.
- Using the website for unlawful, fraudulent, or abusive purposes.
15. Intellectual Property
The Harper Grove name, branding, logo, website design, photographs, graphics, original written content, and other materials provided by us are owned by or licensed to Harper Grove and are protected to the extent provided by applicable law.
You may use the website for ordinary personal shopping and informational purposes. No other license or right is granted except as expressly stated.
16. Third-Party Services
The website may use, integrate with, or link to services operated by third parties. We do not control independently operated third-party services, and their use may be subject to separate terms and privacy policies.
17. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the website and related online functionality are provided on an "as available" basis without warranties beyond those that are expressly stated or that cannot legally be excluded.
We do not warrant that website access will always be uninterrupted, completely secure, or free from technical errors.
Nothing in these Terms disclaims or limits any warranty, obligation, or consumer protection that applicable law does not permit us to disclaim or limit.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Harper Grove will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising solely from use of, or inability to use, the website or online ordering functionality.
To the fullest extent permitted by applicable law, our aggregate liability for a claim arising from a particular order will not exceed the amount actually paid to Harper Grove for that order, except where a different remedy or amount is required by law.
These limitations do not apply to liability that cannot legally be excluded or limited, and nothing in these Terms is intended to limit liability for conduct where such a limitation would be unlawful or unenforceable.
19. Events Outside Our Reasonable Control
We are not responsible for a delay or failure to perform caused by circumstances outside our reasonable control, including severe weather, natural disasters, utility or internet outages, transportation disruptions, government actions, public-health events, labor disruptions, equipment failures, ingredient shortages, supplier failures, cybersecurity incidents, or other comparable events.
When such circumstances affect an order, we will make reasonable efforts to communicate with affected customers and provide an appropriate resolution.
20. Electronic Communications and Agreements
By using our online ordering system, you consent to conduct the transaction electronically and to receive order-related records and communications electronically, including by email.
Electronic actions used to indicate agreement, including checking an agreement box and submitting an order, may be used as evidence of your acceptance of the terms presented to you.
21. Governing Law
These Terms and transactions with Harper Grove are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except to the extent federal law or another applicable law requires otherwise.
Subject to any law that provides a consumer with a non-waivable right to bring a claim elsewhere, legal proceedings arising from these Terms or an order may be brought in a court of competent jurisdiction serving Tazewell County, Illinois.
22. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.
23. No Waiver
A failure or delay by Harper Grove in exercising a right under these Terms does not waive that right or prevent its later exercise.
24. Entire Agreement
These Terms, our Privacy Policy, and any additional terms expressly presented and accepted in connection with a particular order constitute the agreement governing that transaction, subject to applicable law.
25. Changes to These Terms
We may update these Terms prospectively as our business, services, technology, or legal obligations change. Updated Terms will be posted on this page with a revised effective date.
The Terms presented when you submit an order will generally govern that transaction unless a change is required by law or separately agreed upon.
